Legal obligations beyond the BPR
In the second instalment of our 8 part Biocides series we're focusing on the first branch of the decision tree. Your product may not fall within the scope of the BPR, however there may be other legislation which you must ensure your product fulfils such as REACH, CLP or Plant Protection Products Regulation.

Some of these regulations apply to a wide range of chemicals. For example, the Classification Labelling and Packaging (CLP) regulation (Regulation (EC) 1272/2008) requires both manufacturers and importers as well as downstream users to classify the physical, human health and environmental hazards of their substances or mixtures before placing them on the market and is applicable to all industrial sectors.
Similarly, the REACH regulation for the Registration, Evaluation, Authorisation and restriction of CHemicals (Regulation (EC) 1907/2006) applies to a wide variety of chemical substances across many sectors. This includes not just industrial chemicals but also chemicals used in day-to-day life such as inks, dyes, paints and cleaning products.
Other regulations are more specific to the products to which they apply. For example, the Plant Protection Products (PPP) regulation (Regulation (EC) 1107/2009) applies specifically to pesticides used for crop protection e.g. herbicides and fungicides. The cosmetics products regulation (Regulation (EC) No 1223/2009) is relevant to any person or company placing a cosmetic product on the market to ensure safety of the end user, and to regulate label claims.
It is important for a company bringing a product to the market to determine the relevant legislation that applies to their product.
